SIGN SETTLEMENT LETTER OR NO PAYMENT

Nedbank owes me R3 483-04 in damages after their financial planner at the Hyde Park branch, Oliver Kayser, failed to transfer a part of my retirement funds to another fund. My financial loss for his negligence was calculated by Fairbairn Capital to be R3 483-04. On 13 December 2012 Neli Magangane, client complaints manager emailed me a "settlement" letter. I rejected the offer and referred my complaint to the banking Ombudsman. My complaint was dismissed in December 2013 by the FAIS Ombud who found that Nedbank's offer was fair. I wrote to Brenda Hannay on 20 January 2014 to enquire when Nedbank would pay me the R3 483. I requested that she amend the "settlement" letter by inter alia removing 2 paragraphs which protected Nedbank from any publicity around the event and which alleged that the payment to be was made "in consideration of sound business principles" and was "an ex gratia payment". Hannay replied that the "bank is not in a position to change the date or format of the proposed settlement". I refuse to sign a letter that doesn't correctly reflect the incident; Nedbank refuses to pay me until I do, despite admitting that I had suffered a financial loss of R3483.04.
