Defects on a brand new car

I bought a brand-new Hyundai Exter 2025 model from Hyundai Bellville. I didn't even get the opportunity to view or test drive the vehicle before driving it out of the showroom on Saturday, 20/12/2025. When I signed the contract, I noticed that the vehicle had fine scratches. I was told by the salesperson that he would arrange to have the vehicle buffed when I collected the plates. This is a brand-new vehicle I am talking about.

When I drove off, I saw that the vehicle had 80 KM on the clock, which seemed very strange to me as this is not the first time I am buying a new vehicle. I got home and immediately contacted the salesman, who said he was sorry. I then noticed that the wheel nuts were rusted, the left front brake disc was rusted and had fine lines, and the exhaust pipe was also rusted. This is supposed to be a new vehicle.

When I confronted them today, the sales manager made a lot of excuses, saying they can't take the car back due to insurance concerns and that they can only repair the defects. Taking into consideration that this is supposed to be a brand-new vehicle and I signed the contract for a new vehicle, they instead sold me a used vehicle for the price of a new one.

I told them that I want to cancel my contract, but I was told that I must give them time to sort this out. I don't want to, as I am not interested anymore. I can take my business somewhere else where I will be happy, and I am not going to leave it here. I am definitely taking this matter further.
