UPGRADED TO A BROKEN PHONE

I upgraded my contract last year already. They delivered the phone to me. A phone that did not work. This is now the third time Virgin Mobile supposedly "fixed" the phone. I have never had the opportunity to use the phone once, but I am paying every month. I have requested them to replace the phone, but with no joy. Every time they just try to fix the problem. How is it possible that you have to replace a "new" phone's soft ware and battery.

I am paying for a new phone, why don't I get a new phone.

At this stage I am really prepared to take Virgin Mobile to court.
