Ignoring CPA

Hi,
I called to do an upgrade, and as the terms and conditions were being read to me, I as advised that if a phone was returned after 7 days due to a fault, it would be sent to the supplier for repairs. I disagreed as the CPA law says that if something is broken/ unfunctional, I am within my rights to ask for a new phone of the same model. He disagreed and therefore could not go on as I will not say yes to this. He advised that he is reading the CPA law. I'm guessing someone there told him to say that.
