Forced cellphone contract

Last year beginning of November, I was called by a Homemark salesperson telling me about a promotion that they had on a Samsung pocket. I told him that I was only interested in getting a Samsung Note II. As he dropped the phone, after he had agreed that he will sort me out with one (Note II), he quickly said that he will send the Samsung Pocket that I requested and dropped the phone on me.

The phone arrived after a week via a courier service. I told the guys that I am not accepting the phone. They then told me that they can't take it back without Vodacom authorising them to do so, and if it got lost the onus would be on me. I took the package and called Vodacom. The consultant was so nice and understood my situation and said that the phone would be picked up within the next week. In mid-December I called them again twice to remind them. The consultants told me stories, that the request was not logged correctly and processed to the correct department et.

I came back in January, I called them again 3 times. The funny thing is everytime I called the consultants would not be able to trace my last calls. I wrote an e-mail to their customercare and noted receipt but still nothing done.
