False marketing strategy

I bought a phone from Mtn Kagiso Mall on the 27th October 2012. It was a Sony Xperia Go, one thing that attracted me to this phone was that it was advertised as a water resistant phone.
While i was still enjoying my new phone, i answered it on a rainy day, and my charger and earphone port were closed, to my suprise the following day the phone was dead, tried to charge it, it did not respond, i then went with it to the shop.
They took the phone for repairs, while i was waiting nobody bothered to update me, i always had to go to the shop for an update. The feedback i received was that the phone was water damaged and cannot be repaired. That was two months after I gave the phone back. I was also given a number for repair centre i.e 083 9000 349 and the agent told me that i should be given a new phone by the shop
I feel mislead by Mtn and Sony because they advertised the phone as water resistant and at the same time they tell me that the phone has been water damaged.
As a consumer dont i have the right to get a new phone because i only used the phone for a month.
im frustrated because my account is still being debited by Mtn while i dont have a phone at hand.
