Faulty Blackberry Torch (under guarantee)

My Blackberry Torch (contract phone) has been giving problems for a long time now, the phone is dis-functional. It is even worse when any app is loaded. The scroll button doesn't want to work at all. It wil stop working for weeks and I have to use the touch screen, then it would suddenly change vice versa. It gets stuck alot and needs to be switched off completely and turned on again. On Saturday 2013-02-23 I went to Hatfield Vodacom Shop to hand the phone in for repairs (it is under guarantee) The consultant immediately started explaining that he's almost sure Vodacom will not repair the item under guarantee as the device has scratches on it and its not new, which gives HIM the impression that the problem is because of damaged so I must prepare myself to pay the cost for repairs! This is totally unacceptable, he already made a decision without even knowing the problem. IS THIS BECAUSE VODACOM DOESN'T WANT TO LIVE UP TO THEIR STANDARDS, making excuses to save money! WHAT ABOUT AFTER-SALE-SERVICE! I'm having this phone for more than a year now. It WILL have scratches! WHAT IS THIS!!! Doing customers in now?? I WANT THIS PROBLEM ISSUE SOLVED and my phone FIXED!!! ASAP!!
