Not complying 2their 7day out of box failure

My name is Melishka. I am trying to do a "7 day out of box failure" return on my Blackberry Q5 (R 199 x 24mnths) as there is a flaw with Blackberry 10 Software, where it doesnt allow u to delete an email from your Blackberry only&keep a copy of emails on your server, as previous BlackBerrys have once u delete it from the phone it also deletes it from the server, i know this bcoz my brother also contracts with Telkom Mobile/MTN& has had the same problem with his Z10&Q10 for over 8months & has received a call from the main technician in Blackberry to confirm that it is currently not possible. I would thus like to return the phone and take a Samsung S4mini (R269pm X 24) as a replacement contract. The contract is not 7days old so I went to back to the store to exchange it but afterTaurai screaming at me, she, the store manager and regional manager said it is not possible, although the T&C on their website clearly state it. They said I must cancel the contract, pay penalties&then take a new contract. This is ridiculous. Dont they know their own T&C's. Even the call centre confirms that it is possible. Please help. Dreading going back to the store to have staff scream at my family again.
