Refuse to assist

I have been to the 8ta store to replace my handset in the 7day out of box default as the phone battery life is not upto standards.i was refused point blank by the manager of the store which he insists its the 8ta network without a technician on site. im really frastrated as im now losing out on my business clients due to this issue. 8ta terms and conditions stiplulates that the handset should be replaced within the 7day return, I was told that its management discretion of the store to replaced or repair. this does not state in the terms and conditions of 8ta. Please advise on further steps to to be taken as the phone is their pocession and I have prove of the book in of the handset which I was advised it was to be replaced that why the book in needs to tak place but they were out of stock and this statement was made to me by the consultant was actually dishonest as the manager said they had stock, the 7days are now over and they will not replace the phone or cancel the contract but the phone was booked in and is still in their store
