Faulty new iphone 5

At the end of February this year, my brother collected an iphone 5 for me at a Vodacom shop in JHB. He did not open the package but I opened it on the 16/03 and on 17/03 I did a sim swap. During that week I realised the unit was faulty. If I received a call/msg it would ring for a split second and go to silent. On 25/03 I headed to the Customer Care in Gateway and explained what was wrong with the phone and handed it in. I collected it on 07/04 and all they had done was a software upgrade. Testing the phone then and there, it seemed to fine, but later that day it was faulty again. On 08/04 I returned to Vodacom expecting a new phone, but they had to send it in AGAIN. Each time I have either collected the iphone 5 or handed it in, I have had to do a sim swap and next time "The Team" said they would charge me for it, which is not fair because Vodacom gave me a faulty phone and the only spare I have is an iphone4. I don't know how many more times I have to send it in, as I don't think it's a software problem but a hardware problem, and the unit probably needs to be replaced as it faulty. I thought according to the CPA I had 6 months to exchange a faulty phone for a new one?
