Continued billing even after contract exprired

My unemployed husband was offered a contract in 2010, which I ended up servicing. I serviced this account deligently until I became unemployed in December 2011 and I battled to keep up with these payments. I called the call centre and spoke to a gentleman (whose name I cannot recall). I explained the situation to him and requested that since the contract was due to expire in December 2012, could they stop further invoices (the number was disused anyway). He told me as long at there is an outstanding balance, they will continue billing my husband until the outstanding amount is paid in full. They have since handed the account over to attorneys for the issue of summond against an unemployed and disabled man. Will they issue a garnishee (against what salary and to whom)? All I ask is that I pay the outstanding balance up to December 2012!! Issuing a summons is simply throwing good money after bad. I am not obligated to pay for this contract by I am will to settle the balance outstanding only up to December 2012.
