MTN/BLACKBERRY REFUSE TO GIVE ME ANOTHER PHONE

I upgraded my phone when it was time end of August 2012 from a BB9700 to a BB9900. Biggest mistake I've ever made on a phone. The phone lasted about 3wks, it just switched itself off about 20 times a day. I took it in to MTN East Rand Mall, after about 2 wks they sms'd me to say I can come and collect a brand new phone. I got the new phone, which lasted me to mid Jan 2013. Before it totally clonked out the space bar only worked intermittently. It too switched itself off one day and refused to switch on again no matter what I did. I only had time to take the 9900 in beginning March, in the mean while using my old 9700 which still works 100%. They sms'd me again almost 2wks later on 12th March to say I can once again come and collect a brand new phone (9900) but not at the moment because they don't have stock, they'll let me know when they have stock. I cannot accept this no matter what the contract I signed that I have to accept a phone that clearly has a manufacturing glitch and have to wait till MTN has stock. If this is not resolved within the next week by supplying me with another brand of phone i will take MTN to court, no matter the cost, it's a matter of principal.
