Faulty Goods Not Replaced or Refunded - Part 2

On 4th Jan 2013 I signed a 24 month Vodacom Contract for a Blackberry but it was faulty, Vodacomtried to fix it but to no avail as per my Hello Peter complaint: Faulty Goods Not Replaced or Refunded, Wed 30 Jan 13. I called Vodacom Head Office and spoke with Gaynor Assur and asked her for a replacement or refund as per the Consumer Protection Act - she said she will not replace or refund and kept repeating Vodacom's policy of repair only, she said she will send the phone to Johannesburg and if it cannot be fixed then a new phone will be issued. I asked her if Vodacom recognized the Consumer Protection Act but she just kept repeating Vodacom's policy which means Vodacom do not care about the actual law, only their policy is correct! The contract taken out on my phone required me to exchange my old Blackberry. I have read reports about replacement phones replacing new phones and I do not want one of these, I do not want to end up with a second hand repaired phone! I have reported Vodacom to the Office for Consumer Affairs Office for not recognising the Consumer Protection Act - Watch this space for Part 3!!
