Faulty Goods Not Replaced or Refunded

On 4th Jan I signed a 24 month Vodacom Contract for a Blackberry. 11 days later I found that the phone was over heating/ -battery lasted an hour /no phone calls etc. Vodacom checked the phone and said that the warranty is over -gave me a replacement battery to test which worked but had to be taken back -Vodacom said that they would send it for repairs, I said no, I need it for contact with my daughters, I said that I would like a new phone and the reply was-they would send it for repairs without a replacement!!! On 21st I went to Tyger Valley Vodacom and spoke to the Manager AJ Thompson, he said that I have a fauly battery and require a software upgrade andt the phone would be ready on 22nd. On 22nd I was told that the phone was working but the memory card was corrupt and all info had been deleted! On 23rd the phone was no better, my husband called AJ Thompson and said that as per the Consumer Protection Act Vodacom should replace or refund - he said "NO the 7 day warranty is up". On 24th Vodacom Cobble Walk said that they would give me a replacement WHILST THE PHONE IS REPAIRED - I said I want a replacement or refund.
WHERE DO I STAND WITH THE CONSUMER PROTECTION ACT
