Cellphone faulty in 2days.store refuse to refund

I bought a samsung galaxy trend on the 23 Nov, the phone stared freezing, switching itself off and the battery had to be charged twice a day even when i was not using most of my applications. i took the phone back on the 30 Nov, which was the 7nth day. I asked the manager to replace my phone with one of the same model or to refund me if they do not have stock so that i go buy it somewhere else. i was bluntly told by the manager that they will not refund me or replace my phone, instead they are going to take it to vodacom technician to be tested & repaired. i kindly told her that i would not like to have a phone that has been tempered with or ''fixed' in less than a month of purchase and that i would rather have my money back as i bought it for cash. she said she is not going to refund me as i have to wait for my phone to come back. Consumer protection act clearly states that i am entitled to a replacement or a refund. can i have my money back. and can someone from Foschini tell me which Consumer protection act are they adhering to if they do not know this. all i wanted was for my phone to replaced with a new phone as it was only 7 days old., but now i want my money back.
