I received my Samsung S4 on 10 May 2013. Three months later the unit was overheating (burnt ear) even when not charging and freezing. The unit was booked into the Samsung Smart Care Centre at Constantia Business Park for assessment (unbelievably professional service). Main Board, Sub PCB and battery are defective and need replacement. After only 3 months I believe that this unit is sub standard in quality and should be replaced with a new unit. Vodacom Repairs Cresta's terms and conditions state that the exchange unit will be a REFURBISHED UNIT which is not acceptable, and have made note of this on their form. In terms of the Consumer Protection Act (CPA) section 56 (read with section 55), all goods purchased by a consumer are subject to an implied warranty of quality and suppliers can not contract out of this provision. This means that a consumer has the right to receive goods which are:

Of good quality and are reasonably suited for the purpose for which they are intended for.
If within 6 months after a purchase, the goods are found to be in contravention of the above, a consumer is allowed Replacement; Repair; or Refund. etc. I CHOOSE REPLACEMENT.
