FAULTY BLACKBERRY z10

I received my BBZ10 in May 2013 due to an upgrade on my contract. From the start I had problems with downloading data and to sinc all my contact and data from my previous phone. I had to go into MTN store to download the latest software as I have no WiFi access. Still the sinc didn't work. I couldn't download my data or new photo on the BB Z10. I Contact Jonine Siepker at Mtn to assist me with the problem. While trying to correspond by Email with Jonine which took more than two weeks waiting for her response, the sound system on the BBZ10 packed up. Jonine collect the phone and send it in for repairs. No attention was given to the problem of downloading data or photos. Yesterday I received a refurbish phone from Jonine. According the refurbish phone is a new phone in an old casing? Why don't Mtn replace a faulty phone with a new phone? I lost all my data and photos on the old phone.
Please assist me to get Mtn to replace the Blackberry Z10 with a Samsung S4. I pay R190 per month extra on my contract to have a decent phone.
