Vodacom outlet won't cancel UPGRADE-declined OBF

I did an upgrage on 10.08.2013. got a Q10 blackberry. the handset dint work the whole weekend. i returned the handset on Monday following week, was told it needs to be sent for checks... i made it clear that i do not want that phone anymore, "an old OBF format was used and the query was sent back with the phone not checked due to wrong form use. never got feedback unless i call the store. phone sent for the 2nd time to Vodacare, returned with a declined OBF, as an upset customer paying for something im not using, i logged a call with Voda customer care, got a ticket number which was eventually closed and tagged the consultant to call client which he never did at the time he said he would call. the handset is currently at store, store manager wont agree to cancel my upgrade due to the fact that Vodacom wont replace the used handset. now the question is am i forced to take the phone i dot want or i have the right to return and cancel if im not happy. customer service been very poor, and its more transaction than client needs and im very upset. i want the whole contract just cancelled. i have been trying to get hold of the store manager the line is always busy not if number is correct.
