Instability to supply customer service

To Whom it may concern,

I have received a Faulty Out of Box unit on the 07/02/2013, it was reported to my local Vodacom shop before my 7th day expired, however I was not able to get off work to deliver the device, and it was only physically booked in on the 8th day.

I had spoken to a Vodacom representative within 7 days and was told that it will not be a problem should I only be able to book the device in on the 8th day, and that a new device will be ordered.

This was not the case, the device has now been sent for repair instead of being replaced,

As per my right (Consumer protection act No.68 of 2008)

o Consumers are permitted to return goods to suppliers, without penalty and at the suppliers' risk and expense, within a period of six (6) months after delivery of such goods, if the goods are of inferior quality, unsafe or defective.

I would hereby request a new device and not the faulty device repaired. The handset did not fall, get wet, or any sign of physical abuse, why does a repair need to take place on such a case?
