Deposit refunds not paid within contractual agreme

I have been fighting for 3 weeks to get my deposit refunded. The contract says within 10 working days, but this has not happened. The owner is never available and he is the only one handling refunds. The excuses given for his absence are laughable. I can see this ending in a legal battle.
