Lack of Duty of care

I had my procedure January 19th 2022 and it was a failure.
The doctor refuses to communicate with me and I have asked his partner to speak to him with no success.
I am worse now than before procedure.
I believe that because I could only afford medical aid rates he has no duty of care in my case.
Ihave waited till now to give him a chance to respond.
I am lodging a case with HPCSA.
