PASSING OFF OLD PARTS AS NEW

On 22 July 2013 I bought a Honda Ballade steering rack from the above mentioned company, hoping to be supplied with a new steering rack, only to be supplied with a second hand one as I had specifically requested a new part. My mechanic returned the part as it was on 23 July 2013 for a refund and the supplier was rude to him and refused to take part back.

On 25 July 2013 I personally returned the part and still the supplier refused to take back the steering rack and refund me my R4 500, 00 I had paid. On their receipt it is written (something I neglected to take note of unfortunately) No returns after 7 days. "No cash refunds whatsoever."

I submit that the above stipulation in their receipt is contrary to the Consumer Protection Act.

On 29 July 2013 telephonically we agreed me and the owner of Rio's (Riaz Gani) that I must bring back his steering rack and he will give me a Credit Note for R4 500, 00. On 30 July I returned the steering rack and he gave me the Credit Note for the aforementioned amount. The same day in the afternoon he phoned me to tell me that the steering rack was not his, because his was marked, and he is no longer going to honour the Credit Note.
