Eager to take a deposit but not to refund it

I was requested by the salesman Chris to pay a deposit in order to secure a 2nd hand vehicle I was interested in. I paid R5000 deposit on written condition that it be refunded if I decide not to take the vehicle. On 29 August I decided not to take the vehicle after I received a vehicle inspection report from DEKRA (which I paid for) and requested the refund of the deposit.
Despite several emails and phone calls since then, I am still waiting for the refund of the deposit and I can't get hold of Rian via telephone and he ignores my emails.
