BIS charge Iphone upgrade/Refurbished replacement

1st Problem.
My wife Upgraded to an Iphone 4S in October 2012, at the time it was requested to remove BIS from her profile. in December the statement still showed the R59 being deducted for BIS. We went to the branch to rectify... i'm still waiting for Vodacom to call me to credit my account for the BIS i was charged, incorrectly.

2nd Problem.
the same iphone (less than 3 months old) "developed" a charging problem to the point where it could not charge beyond 1%.the phone was booked in at clearwater on 4 Jan where the manager mentioned it would take 7 days to assess and the phone would be replace as per T&C's of the 1 year warranty. Cornell also mentioned to us at time of upgrade that should anything (hardware related) go wrong, we would receive a new phone. after almost 2 weeks the phone is still being "assessed" and it was mentioned to my wife by Dumi, that it could potentially be replaced with a refurbished phone, contrary to what we were told.

I'm extremely dissapointed with vodacom. perhaps they can cancel the contract, keep the broken phone and port me to cellC or even 8ta for that matter. i'm sure any other network can offer better service.
what can i do? be proven wrong?
