Phone got lost, they want to keep me responsable

My Phone got lost on Friday, I only missed the handset Saturday morning, when woke up I phoned it from my, it rang, went to my car and phoned it again to hear if it is in the car, I did not hear it.
I went to the house where we had a braai, I call it again, it was switched off.
I went to Autopage in Vodaworld, I was standing in the queue as there was one agent helping.
He then did a sim swap, I did not had my Rica documents with me, I email him the documents and the IMEI .
I phoned him on Saturday, he was not avail, so I left a message, he dit not return my call. I contacted him again on Sunday, he then said that he did activate the sim, the sim must be faulty. I then asked him if he did blacklist the handset, he said no, but he will do it now. So now I must wait longer for the ITC number.
Last night I checked my emails, then I saw an email high usage alert! Now even my new simcard is suspended!
And the call centre agent said that I am going to be held responsible for the call's and data usage?
and I am not going to pay for the data or calls, I want autopage to refund the data and calls, Or I am going to the NCA and autopage can then close my contracts.
