Have not delivered a working handest

On the 6 November 2012 cellc direct delivered a handset that was not working properly on the 8th i sent my wife to cellc to see if maybe we got the settings wrong, they could not find a problem with the handest and told her to go to cellc vincent. She dealt with a guy by the name of Zim he said the software was in need of a upgrade there is a 7 day window period in which a faulty handset can be returned, Zim would not book the handset in as the contract was in my name. I work shifts so it is not easy for me to get to cellc, i eventually was able to see a lady at cellc who listened to my story and agreed that the handset be sent in and replaced. 2 weeks went by and i never heard from cellc, eventually i received a sms to tell me the fone has been received at the repair centre and will be repaired, we agreed on a replacement no a repaired faulty handset. i got hold of cellc and they said that the handset has been damaged, it had a scratch on the lense and back cover, who scratched it me or 1 of the cellc technicians, who can prove anything? there attitude is you signed for it so it wasnt scratch, i signed for it when it was in a sealed box. its now 17 February and no cell
