Phone was working and now returned broken

I got my Blackberry 9790 in Mar 2012 & the battery life of my phone was bad from the start. I was charging it twice, sometimes thrice a day! I could not send the phone in as I did not have a spare phone to use while it went in. I eventually sent it in 1 Feb 2013 and collected the phone 5 Feb 2013. I was told they tested the battery as well as the phone and could neither find a fault with the battery nor the phone, but they did a software upgrade anyways. I tried to do a restore on the backup for the phone this morning and now I have to plug and unplug the phone a few times before my computer picks it up. When the restore is done, I have no bbm contacts. The phone was working (able to do back and restore) before I sent it in for the battery to be checked. My computer picked it up immediately when I connected the phone via the USB cable. Now it doesnt. It wastes a lot of time taking the phone in as you are always left to wait for a long time to be served and to collect the phone. So I have wasted much time and now my phone is in a far worse state than it was before I sent it in. My spare phone is waiting to be senf it. Dare i try and send that 1 in. That phone is not even 3months old!
