Warranty on my phone

I got 2 contract phones from heita south-gate on the 11-11-2011, my one phone started giving problems kept on freezing and I took it to south-gate heita and they send it in for repairs 28-07-2012. They told me it will take 3 weeks I ended up waiting for my phone 2 months, they ended giving me a new phone on the 20-9-2012. The same new phone I've got it now for 10 month's and the trackpad just gave in, I send it in on the 7-6-2013 and they send me a sms saying that I must pay R908.35 I phoned the manager at telkom direct trade-route mall and told her this is a different phone and different imei: number surely it must have a different warranty because on the contract it states - 12 months warranty on all telkom mobile products. She said the warranty is for the contract not the phone, Please be so kind to assist because according to my knowledge the warranty on the product starts the day I receive the product not the day I sign the contract.
