Damaged Cellphone: New Sony Experia Z1

My name is Nodumo Diko.
I bought my phone on contract through MTN DSP and sales consultant was Baratoa.
On 26 November 2013, the phone was delivered at my residential address through courier company called RTT. Delivery man delivered the phone at 19h50. He came inside and I provided him with copies of ID and proof of address. He then proceeded and opened the phone, set it up, puting in simcard, batteries etc.
At some point, I picked up that he was using car keys trying to open the phone and asked him if what he was doing was not going to damage the phone. He then stopped and used his hands. He put in in a charger and told me not to use it until the following day.
Since it was dark, I could pick up damage. On the following day, I went to work without checking the phone. On my return, I took the phone and only find out that the screen cracked. I then sent e-mail to MTN DSP but they never responded to date. On Friday, 29th, I started following the matter. It was mission to get Baratoa and eventually got her. They said that they were investigating till todate, the phone is still with me and no one is coming back to me to tell me outcome of this whole issue.
