Refurbished contract Phone

I upgraded in January 2013. My Blackberry starting to give problems. On 5 August I took it back to the MTN Franchise shop. They took my phone and send it away for repairs. Two (2) weeks later a phone that was refurbished was given to me. The port for recharging my phone was too big and I could not use my blackberry original charger. I took it back again they have send it again for repairs. On the 12 of September I received another refurbished phone. I started to reload my contacts again and the phone just switched off. I thought that it was not charged. I switched the phone on and saw that IT WAS CHARGED. This morning it switched of twice by itself. As soon as the shop open I am taking it back again. I am paying for a phone that is more in the repair workshop. I am not happy with this, I am considering to change my provider. I also think that MTN is in breach of contract because this serial nr of this phone is not the same as the one on the contract that I have signed for. I think I must go and see a lawyer. This is absolutely poor service
