Iphone 5, Refurbished unit

On 23/02/13 I received an Iphone5 on contract from Vodacom. After three months the phone had connectivity problems. On 10/06/2013 I sent the phone in for repairs and they sent it to Johannesburg. On 13/06/2013 I got a phone back and my understanding was that it was a new Iphone5. After three weeks using this new phone I had problems again, this time with images and video's. The battery life was also much shorter than my first phone. On 8/07/2013 I took the phone back to the Vodacom store and they told me that the "new" phone was actually a refurbished phone. They then sent the phone away again (for the second time) and it came back on 12/07/ 2013. So I sent it back. They told me my software was not up to date and that I must limit my location services, according to the fault report. But before sending the phone for repairs I did a factory reset, therefore the software will be outdated. I want a new Iphone5 and not a refurbished phone that is worse than my original phone. I did not buy a refurbished phone when taking out the contract. Apple`s warranty claims to repair YOUR phone, not give a refurbished piece of. Why did I not get my original phone that went in for repairs back?
