Failure to repaire my phone

On the 22th may I took my blackberry 9360 in for a software upgrade the phone was still under warranty since it was a contract phone from mtn kenilworth branch. The 28th may they informed me that I have to pay a amount of R1500 for coametic repair to the phone. When the phone was given in to the shop there was no damage and it was also marked no damages only upgrade. Since that time they have been refusing to fix the handset. They first said that they going to fix it because they can't find out between the shop and the service department where the phone got damage. Now on the 28th june I was informed that they not fixing the phone because the phone was received broken. I didn't send a damage phone to them and would like the problem resovled as soon as possible thank u Mr Michaels
