7 month old Blackberry warranty expired

I am so disappointment in MTN. got a Blackberry 9360 for my wife for her Birthday from CNA (MTN) on my account the 31/10/12. seven months later when the phone was payed in full the track pad gave problems and we send the phone back to be repaired. MTN JHB told us that the phone has physical damaged and was quoted @ R1400. now i mean the phone was never dropped because my wife is holy when it comes to her phone. we dont have that kinda money and she needs her phone back repaired or replaced. please contact me for IME number ETC spoke to Thato Modise at the Repairs department and she not very helpful. i will get legal wise involved if this is not sorted before month end. i will also stop my contract with them. BAD BAD.
