PROBLEMS WITH BLACKBERRY CURVE 9320

I upgraded in October 2012, so my phone is 8 months old. Since I got it the battery life has been pathetic. One day I noticed that my phone is skew, it also heats up when I listen to music. When in Natal I went to a Vodacom Shop and they told me that Vodacom would not replace the phone as they will send it back to BlackBerry to be looked at, if BlackBerry decides it can not be fixed then they will supply me with a refurbished phone, what utter nonsense it that! And if they do send in my phone, will I be given a lend phone for the time my phone is sent in? I must also add that this will surely be my last BlackBerry EVER!!!
