Dlink dap-1360 Route

Bought this router a little more than a month ago.
Initially I used to to act as a range extender for another netgear router where I had my adsl connected.
It did work, but I had to reset it every other day due to it crashing and hanging.
Recently I has become much worse, pretty much to the point where it crashed more than once a day.
After doing some research and finding a thread online that pretty much proved that a lot of other people where having the same issues I contacted Computer Mania immediately.
Due to nature of the problem it is clear that is a firmware issue from Dlink and it effectively renders the router defective.

This is the response I got from Computer Mania :

"Unfortunatley we ca no longer swop out or exchange the product as it is out of the 10 day swopout/exchange period. If there is however something wrong with the unit we will gladly send it to the supplier and ask them to repair the unit and attempt to resolve the issue that you are having".

I have already flashed the latest firmware, but the same issues persist.
So why can't I have the unit replaced with another working router?
Consumer act clearly states that I should have that option.
