Back in April 2024, I made contact with a real estate agent named Neville Hornsby after I saw his contact on a house being sold on 9th Street, Bishop Lavis. After we made contact, he informed me that the house was already sold, but he did have a house on Limpopo Road, Bishop Lavis. He picked up my wife and me one Sunday and drove us to the property. As we got there, he told us that we couldn't enter the property because the people living in it wouldn't give him access for the day.
While we drove back to our place, he gave us an OTP (offer to purchase), saying the property was hot on the market and we needed to move quickly. Right after we signed the property, he actually told us that he was the one selling it and it was under his son's name. But he had tenants who didn't want to move out. However, he assured us that the tenants would be out before we signed off on all documents.
In October 2024, we officially became the owners of the property, but to this date, we have never set foot on it. The tenants don't want to move out, and Mr. Hornsby is blatantly ignoring me. He did appoint a lawyer on our behalf to help with the eviction process, but after making contact with the lawyer on the 5th of September 2025, he still hasn't gotten back to us. He reads our messages but doesn't respond, and neither does Mr. Hornsby.
To make matters worse, Mr. Hornsby promised us that he'd reimburse us for our bond costs as long as we weren't in the property. He last made a payment in March 2025, and we are already R17,800 in arrears. Next month will be our first anniversary as homeowners, but other people live in our home. The tenants don't want to move out. Mr. Hornsby doesn't keep us up to date, nor does his lawyer.
The bond is 90% of my salary. We live on my wife's salary, which she still needs to use to pay for her transport, crèche fees, rent where we are currently living, aftercare for our eldest daughter who is only 9 years old, and food. We can't even afford to buy ourselves underwear or anything because we don't have the money to. If we were on our property, it would've been better. We could've rented out our garage for a penny, or if Mr. Hornsby could pay the money, as he promised, we'd be in a better financial position.
