Damaged tablet not replaced

I took out a contract with Bayport for a tablet. Upon delivery of the tablet by their courier service i found the tablet to be damaged. Upon calling their call centre for assistance i got non. I was pushed from pillar to post and no-one wanted to take responsibility for replacing my tablet. I was refered to thier Durban branch for a replacement. Upon getting there the store refused to help me, stating that i needed to deal with their headoffice. I finnlay got hold of Colin, a team manager who said he will back to me. I am still waiting for his call. everythime i call for him he refused to take my call therafter. I finally had to courier the tablet at my expense to a family member in JHB, who took it to bayport. They issued a letter stating that the tablet will be replaced. Upon following up with their call centre they are now saying that they are still addressing the problem, they have until Feb to decide if they want to replace the pad? I have paid 3 months for a contract i cannot use and they issed me with a letter saying they will replace the tablet. I need my replacement or cancel my contract
