Nedbank not taking ownership

On the 03 July 2013 I received a sms via in contact @ approximately 09h15 the morning purchase of R3999 done at a Game store. Shortly thereafter another sms came through of an ATM withdrawal of R1000 and thereafter the last R50 was withdrawn as well both transactions from an FNB atm and I bank with Nedbank. When I checked my ATM card was intact in my purse. I was on shift that morning, so during my lunch break I went into the Nedbank branch at the Randburg square to query these transactions. I was told an investigation will be done which would take approximately 6 weeks. Last Friday I received feedback from Nedbank stating they will not refund me as I was negligent and this is a prevalent criminal activity at the ATM, they also told me a hot card was captured on the system and they received a copy of this card with my details at their offices. I haven't lost the card nor does anyone know my pin number, so how was I negligent? Please help I need this funds back as this incident has created endless problems. Case number 2013G599
