Damaged phone???

My blackberry gave a simcard error, was sent in twice, first time came back nothing physically wrong with phone but "signal" problem, problem was not fixed I took it back the next day after 3 weeks came back physical damage with a photo of the "damage" cell c did not want to replace phone according to the report it was physical dmage??? So who damaged it as it was sent in the next day after the first repair, I took out another contract with cell c as I need a phone urgently, back at home I insert another simcard which had no bbm facilities on and the phone work perfectly, so if it was physical damage how can the phone work, this means that it is a manufacturing problem, but the policy of the cell c shop is not to replace the phone, the assistant at cell c confirm that he was witness what the problem was in the first place, but he can do nothing about it. So I think it is unfair that I was not giving another phone, and the "damage" one sorted out by the owner of the cell c shop!
