Black Berry 8520 replaced 5 times by MTN

Please note this is a ongoing problem since 03 Aug 2012 to date.
I have purchased a 8520 black berry via MTN direct, i have being experiencing software problems when taken in to MTN Campus Square, other than it being a contract phone the company could not prove i had a warranty after days of dealing this matter i managed to find the pop at the time dealing with Beggie.
There after i have handed my phone 5 times in, when originally handed my phone in, it was brand new and only had software problems, i there after have being every time being given refurbished phones with more than just software issues but mechanical issues as well, let alone the fact that the phone comes back in worse condition than ever sent in with scratches and dents on the phone.
I find it unacceptable to have given a phone in immaculate condition to receive one a phone that was also sent in which initially had a problem to begin with and still be second and to your phone you have originally given in?
I also have noticed the time in which my phone is so call replace seems to be a delay to ensure my warranty falls on the phone so i cant complain any more.
I will not accept any thing less than a new black be
