Complaint / review / scam report

I am writing this complaint because it is about time Foschini comes to the party and sort out their staff, sort out their relationship with MTN and treat their customers with respect and not like! In November 2011 i bought a brand new Blackberry 8520 and since then we had up to seven phones and upgrading of software. The most annoying thing is that Foschini is has no idea that every time the phone is returned after being sent to MTN it is a replaced with a refurbished phone and NOT a new phone and this is simply the reason why the phone is constantly giving problems. I have just received another refurbished phone sent back by MTN when the phone stopped working and the date on the phone is 1 MARCH 2006. Now can some at Foschini tell why i must be given a phone that has that manufacture date on it, when i purchased a brand new phone on 28 NOVEMBER 2011. I firmly believe that the problem will never be solved because Foschini is binding its time until the two year warranty falls away and then the problem is mine alone. I have decided that taking the problem to the Retail Ombudsman might just resolve the above problem.
