Second Time

On 30 January 2013, I sent in my Blackberry 9300 to Cell C's Repair Center FOR THE SECOND TIME.
After the first time, they only updated software and within weeks the phone was acting up in the same manner it did before sending it in. Today, I received a msg from the Greenstone branch to inform me that my phone is ready for collection. When I asked the assistant in store what they did to the phone, she told me a software update. I was furious seeing as this is not solving the problem. Furthermore, on close inspection I realized that my phone was damaged while in Cell C's posession (scratched on the screen).

Please can this be sorted out? I want the phone properly fixed or replaced seeing as I am paying for a consumer good which is malfuntioning!
