Virgin Mobile commits against a subscribe

My mother spoke to the call centre to upgrade her contract in October 2012. Everything went fine on the phone, R299 special, Galaxy S3, R322 total monthly cost including itemised billing. Contract approved, and phone to be delivered the next day. No phone arrived and a week later she called to query and was informed that in 10 working days it would arrive.

After a month of no phone, I bought her a phone and told her that she might as well stay on her month to month contract.

Due to health problems she hasn't been able to monitor the accounts and statements until today when she looked at them and they are huge amounts, over R500 each month!

BUT STILL NO PHONE, NO RICA, NO SIGNED CONTRACT, NO TERMS AND CONDITIONS, NO ITEMISED BILLING (which was mandatory for this contract).

Does this mean that someone else has had a nice brand new Galaxy S3 that they didn't pay for, for 4 months?
