No service on warranty cellular phone

Good day

I have a contract with Mtn from December 2011 but due to insuffecient stock I only received my phone in January 2012, I was up for an upgrade and as for a faulty phone I was informed by Mr Jason Hansen repairs would be done on it for free, thus I would find out afterward the service provider would not cover the repairs as the warranty expired. According to my records I received the phone at the end of January 2012 and the warranty would expire on January 2014, which inturn makes me in my legal rights to have my phone still fixed. I think MTN is just dodging the repair process, as it would just save them money, but as a loyal customer I feel deprived of my rights as a consumer and needs urgent assistants please.
