Battery missing

Hi my name is Penelope Motaung. I bought a samsung galaxy note3 at Vodacom through Smartcom on contract in November 2013. It heppened that on the 6th December it fell into the water and went off totally so the following day on the 7th i took it to Vodacom Repairs at Cresta Mall and they took it along with the battery and gave me back my SIM and S pen. They have been sending me smses updating me about my phone that it has gone to the advanced repair center and whatsoever. Then on the 23rd they sent an sms telling me to come fetch my phone as it is now ready for collection so i went there and i gave out the paper that you come along with to collect and the consultant took the paper and told me that he is going to fetch the phone at the warehouse as it has just been delivered so i waited for him while he is gone. He then came back with my phone and told me that there is a problem and that problem is they can't find the battery of which it's lost. The assistant manager told me there is nothing he can do and really they have'nt been doing anything about this instead they are full of empty promises. Now i am paying for the phone i am not using because of their bad service. HELP ME PLZ!!!
