Really Bad Service

I have taken my newly purchased cash cell phone as the battery hardly lasted a day, it being under warranty
I returned it to the store. I have not heard from the store after 10 days, after 3 weeks I went in myself to discover
the phone had been there all this time. Upon returning home there were specific apps like music, games etc on the phone which was not there before, software that was new I suppose but the phone kept on freezing.
I returned the phone requesting answers as to why these specific app were on the phone and was told that
it was due to an upgrade/software change. The way in which this consultant spoke to me was an absolute
disregard with such bad attitude in rolling her eyes, like I did something wrong. This in spite of me being frustrated already with the service I am receiving. To date it has been 1 week, I have not heard from the store.
The bottom line is this was not my phone I handed into the store, I sent it in for a battery problem but instead it came back a totally different phone with software problems.
