OBF- can`t swop out Iphone 4

I applied for a contract online, a call centre called me, and he convinces me to take the iphone 4 8gb knowing that the phone was discontinued. I found that out when I was inquiring about where my phone was because it is to be a next day delivery. I said cancel my order. on the 18-10-2013 the iphone was delivered. then i found out that the ear speaker is not working and the iphone cannot be connected to itunes to sync it with my pc. I called 0821950 and spoke to rifilwe and she said they can`t replaced it beause the phone is discontinued and might have to repair it but she will get back to me. it is about 48 hours and no reply yet. i called 0821945 and the lady told me they don`t swop out Iphones i have to contact apple. what they supply me a with faulty phone now they don`t want to take responsibility? It is an OBF and i want a new iphone 4 8gb. That is why we have cpa, or is it a joke?
