Refurbished phone non aceeptance

My daughters phone, which we purchased was taken into a Nashua store for repair. The phone was 4 months old. 3 weeks later we were notified that there was a replacement phone at the store for her. When they arrived to collect the phone, it was a used, refurbished phone. When we tried to find out where the original phone was and why it had not been repaired we were not given a satisfactory response.
After 2 weeks, we are still trying to find out where the original phone is, and have had no answer. I spoke to Blackberry and they told me that I could bring it to them for repair under warranty.
The technical Manager tells me that the phone was sent to MTN for repair and they may have sent it to Blackberry. The reason being that they could not repair the software and hardware problem that they found. What kind of a repair center can not repair something?
We refused the refurbished model as once we accept that, then the whole matter will be dropped. We were supposed to be contacted and kept informed of the repair but that never happened. Now we have no phone and no answer as to where it is. Bad communication leaves me feeling that our property was
