Bad customer service

I bought an HTC One beginning of August 2013 and the third week into using it, it started to reboot continuously with multiple pin code requests followed by a loss of network coverage. After a while it would freeze up and not respond to anything, not even a hard reboot. I then took it to Vodacare Menlyn at the beginning of September 2013 to get it checked. Up until today I have not gotten my phone back nor any help whatsoever. The people at Vodacare are now telling me that my phone's LCD had physical damage and alleged that I took it somewhere for repairs, as their report states "temper evident". Why would I take a 3 weeks old phone that is under warranty that has never had any physical damage to be fixed somewhere and pay for it? Could it mean that I was given a phone that they had initially sold to someone else, that was later brought back due to damage or factory fault in exchange for a newer one? Maybe they are the ones that had tempered with it before while fixing it and tried to resell it. If i were to request a newer phone, will "my current phone" which I have apparently tempered with be sold to another individual, with new packaging? Do i get a new phone or cancel my contract
