New Contract Faulty phone

Good day

I applied for a Top Up contract with MTN and my phone (Nokia311) was deliverd to my workplace on 29/8/2013. Since the second day the phone was not working, I took in into the Alberton MTN shop to Janine and it came back after a week that the assesment was declined. I called in again and was told to take it to MTN in Lambton where it will be sent to Midrand. It once again cam e back as declined. I called in again and was told by a Lee Ann at 011 8089001 that Gloria was the sales person and the phone was never booked for assesments. I send a complaint to the Ombudsman on 1/10/2013 and today they replied that they cannot assist as it is out of their jurisdiction.
I emailed another complaint to [Email Removed] and awaiting feedback.
I already paid my first debit order with no phone to use.

Please please can someone assist?
I do have the emails shuold you require it.
